Terms and Conditions

Pigeon Mailer — Effective Date: August 11, 2026

Pigeon Mailer is an email marketing platform owned and operated by amarConsultant (6/4A Orphanage Road, Lalbagh, Dhaka-1211, Bangladesh). By creating an account or using Pigeon Mailer ("the Service"), you agree to the terms below.

1. Eligibility

You must be at least 18 years old and able to form a legally binding contract to use the Service. By registering, you confirm the information you provide is accurate and that you have the authority to send emails on behalf of any account you manage.

2. Your Account

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at info@amarconsultant.com if you suspect unauthorized access.

3. Acceptable Use

You agree not to use Pigeon Mailer to:

Send unsolicited bulk email ("spam") or emails to purchased, rented, or harvested contact lists without proper consent
Distribute malware, phishing content, or deceptive subject lines/sender information
Send content that is illegal, defamatory, obscene, or infringes on third-party rights
Violate Bangladesh's Digital Security Act, ICT Act, or any applicable anti-spam or data protection law

We reserve the right to suspend or terminate accounts that violate this policy, with or without notice, and to reject campaigns that fail internal deliverability or compliance review.

4. Lists and Consent

You are solely responsible for obtaining valid consent from every recipient on your mailing lists. Every campaign must include a working unsubscribe link. Recipients who unsubscribe or use the "Block My Email" tool must not be re-added to future sends.

5. Fees and Billing

Paid plans are billed according to the pricing shown at checkout. Fees are non-refundable except where required by law. We may change pricing with prior notice; continued use after a price change constitutes acceptance.

6. Service Availability

We aim for high uptime but do not guarantee uninterrupted service. Scheduled maintenance, third-party ESP issues, or events outside our control may cause temporary disruption. We are not liable for losses arising from such interruptions.

7. Intellectual Property

Pigeon Mailer's software, design, and branding remain the property of amarConsultant. You retain ownership of the content and lists you upload, and grant us a limited license to process that data solely to provide the Service.

8. Limitation of Liability

Pigeon Mailer is provided "as is." To the maximum extent permitted by law, amarConsultant is not liable for indirect, incidental, or consequential damages, including lost revenue or lost data, arising from use of the Service.

9. Termination

You may close your account at any time. We may suspend or terminate accounts for breach of these terms, non-payment, or misuse that harms our sending reputation or other users.

10. Changes to These Terms

We may update these terms from time to time. Material changes will be posted on this page with a revised effective date. Continued use of the Service after changes take effect constitutes acceptance.

11. Governing Law

These terms are governed by the laws of the People's Republic of Bangladesh. Disputes shall be subject to the exclusive jurisdiction of the courts of Dhaka.
